Norfolk party bus did not have legal permit when woman fell to her death

State police say the bus was entering an Interstate 264 in Norfolk last October when Kisha Marrow-Lott fell from the bus. She died at the scene.

NORFOLK, Va. — Kisha Marrow-Lott’s husband, Jawoski Lott, is suing after his wife died falling out of a party bus near Waterside Drive. 

He filed a lawsuit for $25 million.

State police say the bus was entering an Interstate 264 in Norfolk when Marrow-Lott fell from the bus. She died at the scene.

The Norfolk Commonwealth's Attorney's Office told 13News Now they are not filing criminal charges. In a letter, Chief Deputy Brent Johnson called the incident a tragic accident and said it was not a criminal act on the driver or anyone else on the bus.

The lawsuit Lott filed is for negligence. 

The paperwork said Lott is suing Michael and Shannon Wheeler for $25 million. According to paperwork, the Wheeler's owned and operated a party bus under the name, "Rolling with the Wheelers." The 1998 Ford Super Duty RV was modified for transferring people for special events.

The lawsuit claims, Marrow-Lott was thrown or fell out through an open or unsecured side door and the bus ran over her. It states the Wheelers failed to operate the party bus in a reasonably safe manner because the company failed to warn passengers that the side door could come open while driving, the owners did not inspect the door to make sure it was locked or secured, and they failed to provide seat belts for passengers.

Lott is also suing for damages for loss of income, mental anguish and funeral expenses. The lawsuit also states Lott is demanding a jury trial.

The Virginian-Pilot reports that the Virginia Department of Motor Vehicles says the bus that Kisha Marrow-Lott fell out of during a bachelorette party was not "a legal passenger carrier." Unauthorized operators are common in the party bus and limo industry.

The 37-year-old was a mother of two teenagers.
